By purchasing, minting, receiving, or interacting with any NFT produced or distributed by Gopher Games Ltd (the “NFTs”), you acknowledge and agree to be legally bound by these Terms. If you do not agree to these Terms, do not purchase or interact with the NFTs.
1. Purpose of the NFTs
Gopher Games Ltd is developing a mainstream, narrative-rich role-playing game (“Project Bramble”), to be released on platforms such as Steam and consoles. The NFTs were issued as a Kickstarter-style digital collectible fundraiser to support game development.
These NFTs represent collectible characters or items inspired by the fictional world of Project Bramble. They do not represent financial interests, shares, securities, royalties, or entitlements of any kind.
2. Intellectual Property (IP) Ownership
2.1. Full Ownership by Gopher Games
You acknowledge that Gopher Games Ltd retains full, perpetual, exclusive ownership of all intellectual property rights, including but not limited to:
The game “Project Bramble” and any related games, expansions, or spin-offs
The world, lore, characters, creatures, geography, items, storylines, dialogue, quests, and environments
The names, logos, branding, trademarks, and associated designs
All digital art, animations, concepts, audio, and assets
All websites, social media, marketing materials, and written content
This includes all existing content and future adaptations in any form (print, digital, film, merchandise, etc.).
2.2. Limited License to NFT Holders
If you lawfully own an NFT from our official collections, Gopher Games Ltd grants you a non-exclusive, non-transferable, revocable, personal-use license to:
Display the NFT on personal devices, profiles, and galleries
Use the NFT as a profile picture or within personal, non-commercial collections
This license is subject to these conditions:
No use in commercial products or services
No alterations or derivative works
No use implying partnership, sponsorship, or official endorsement
No use in hate speech, offensive, obscene, defamatory, or political content
No registration or claim of IP rights
Any commercial use, including merchandising, licensing, or publishing, is strictly prohibited without prior written approval from Gopher Games Ltd.
2.3. No Derivative Rights
You do not acquire any ownership of the underlying character, story, world, or mechanics by owning an NFT. These are entirely retained by Gopher Games Ltd.
No rights are granted in connection with:
Game logic, mechanics, quest design
Narrative arcs or characters
Sound design or music
Code or underlying smart contracts
3. No Guarantees or Financial Representations
NFTs are collectible digital art assets and not investment products. Gopher Games Ltd makes no representations about:
Resale value, rarity, or future worth
Access to exclusive game features, in-game benefits, or monetization
Ongoing support, resale markets, or price stability
NFTs do not confer voting rights, equity, dividends, tokens, or royalties.
4. Game Content Is Subject to Change
All content, features, and references related to the NFTs or the game are subject to change during development. The inclusion of specific characters, designs, or elements in the game is not guaranteed.
5. Risks and Liability
You acknowledge and accept the following:
NFTs and crypto assets are experimental, volatile, and inherently risky
Blockchain networks may suffer downtime, attacks, or forks
We are not liable for any losses due to wallet hacks, smart contract bugs, or blockchain malfunctions
You are responsible for your own wallet security and private keys
To the fullest extent permitted by law, Gopher Games Ltd disclaims all liability for damages arising from:
NFT interactions or marketplace activity
Game delays, cancellations, or modifications
Misuse of any granted license or IP
6. Your Obligations
You agree to:
Not infringe on our IP, branding, or creative works
Not impersonate Gopher Games or our team
Not represent yourself as affiliated with us beyond lawful NFT ownership
Not use the NFTs or content for illegal or unethical purposes
We reserve the right to revoke any license or access if you breach these terms.
7. Acceptance of Terms
By minting, buying, trading, or otherwise obtaining an NFT, and/or by ticking the “I Agree” checkbox at mint or browsing our website, you affirm that:
You have read and understood these Terms
You agree to be bound by them in full
You are over the age of 18
You are not located in a sanctioned country or region
